National Employment Standards

122 new Modern Awards replaced the old state and federal Awards on 1 January 2010 and businesses are obliged to ensure that the correct Modern Award or Awards is applied to their employees. Severe fines and penalties are imposed by the Fair Work Ombudsman for Modern Award breaches which include paying employees under the wrong Award. As the Fair Work Ombudsman does not provide binding advice to employers and will not determine Award coverage upon request, it's essential that you get this right.
